1. About us
This website, eastwickplantcentre.co.uk, is operated by Eastwick Plant Centre Limited (trading as "Eastwick Plant Centre"), a company registered in England and Wales under company number 08656341. Our registered office is Knolton, Overton On Dee, Wrexham, LL13 0LE, United Kingdom. In these terms, "we", "us" and "our" refer to Eastwick Plant Centre Limited.
You can contact us by email at contact@eastwickplantcentre.co.uk or by phone on +44 1978 710848.
Our store is hosted on Shopify, which provides the online e-commerce platform that allows us to sell our products to you.
2. These terms
These Terms of Service ("Terms") apply to your use of our website and to any order you place with us. By using our website or placing an order, you agree to these Terms, together with our Shipping Policy, Refund Policy, Payment Policy and Privacy Policy. Please read them carefully. If you do not agree, please do not use our website.
We may update these Terms from time to time. The version that applies to your order is the one published on our website when you place the order.
3. Using our website
By placing an order, you confirm that you are at least 18 years old and able to enter into a legally binding contract. You agree not to use our website for any unlawful purpose, not to attempt to gain unauthorised access to our systems, and not to interfere with the security or operation of the website.
4. Our products
We take care to describe and display our products accurately. Colours may look slightly different on your screen, and packaging may vary from that shown. Any plants, flowers or accessories shown in product images for display purposes are not included unless the product description says so.
All products are subject to availability. If an item you have ordered is not available, we will tell you as soon as possible and refund you in full for that item.
5. Prices
All prices are shown and charged in pounds sterling (GBP £). Delivery within the United Kingdom is free, so the total shown at checkout is the total you pay. If we discover an error in the price of an item you have ordered, we will contact you before dispatch to ask whether you want to continue at the correct price or cancel your order for a full refund.
6. Placing an order
After you place an order, you will receive an email confirming that we have received it. This email does not mean that your order has been accepted. Our acceptance takes place, and a contract between you and us is formed, when we dispatch your order. We may decline an order, for example if an item is unavailable or there is an error in the price or description, in which case we will refund any payment in full.
7. Payment
Payments are processed securely by Shopify Payments, and payment is taken when you place your order. We do not accept PayPal, Klarna or cryptocurrency. Full details are in our Payment Policy.
8. Delivery
We deliver to addresses in the United Kingdom only, free of charge, using Royal Mail. Orders are processed Monday to Friday within 1–2 working days (order cut-off 16:00 UK time), and delivery takes 3–5 working days after dispatch. Full details are in our Shipping Policy.
9. Cancellations, returns and refunds
You can cancel your order at any time before it has been dispatched. After delivery, you can return items within 30 days of receiving them, as set out in our Refund Policy.
As a consumer, you also have a legal right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel your contract within 14 days of receiving your goods. Our 30-day return period is in addition to this right and does not reduce it.
10. Damaged, faulty or incorrect items
We are under a legal duty to supply products that are of satisfactory quality, fit for purpose and as described. If an item arrives damaged or we send you the wrong item, please contact us and we will cover the cost of returning it, as described in our Refund Policy. Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015.
11. Our liability to you
If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. We are not responsible for any loss or damage that is not foreseeable. We supply products for domestic and private use only and have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law, including your rights as a consumer.
12. Website content
The content on our website is provided for general information. While we aim to keep it accurate and up to date, we do not guarantee that it is complete or free from errors. Our website may contain links to third-party websites, which we do not control and for which we are not responsible.
The content of our website, including text, graphics and logos, is owned by or licensed to us and may not be copied or used without our permission, except for your own personal, non-commercial use.
13. Your personal information
We only use your personal information as set out in our Privacy Policy.
14. Other important terms
If any part of these Terms is found to be invalid or unenforceable, the remaining parts will continue to apply. If we do not enforce any of our rights immediately, this does not mean that we have waived them. These Terms, together with the policies referred to above, form the entire agreement between you and us in relation to your order.
15. Governing law and jurisdiction
These Terms are governed by the law of England and Wales. You can bring legal proceedings in respect of our products in the courts of England and Wales. If you live in Scotland, you can bring legal proceedings in either the Scottish or the English and Welsh courts. If you live in Northern Ireland, you can bring legal proceedings in either the Northern Irish or the English and Welsh courts.
